Nev. Admin. Code § 706A.180 - Notice to Authority required regarding person on call as driver; Authority to create and maintain list of drivers; validity of notice; failure to provide notice; records and files of Authority not public records
1. A person shall not be on call as a driver unless the transportation network company with which the person is affiliated has provided notice to the Authority pursuant to this section in a format approved by the Authority.
2. A transportation network company shall not allow a person to be on call as a driver unless the company has notified the Authority that:
(a) The person has met all of the requirements of NRS 706A.160; and
(b) The person is employed or has entered into a contract, or has an offer of employment or for a contract, to provide transportation services in affiliation with the company.
3. The Authority will create and maintain a list of drivers for whom a transportation network company has submitted a notice pursuant to subsection 2. Such a notice is valid for 1 year but lapses if the driver ceases to be affiliated with the company that submitted the notice. A transportation network company must notify the Authority within 10 days after the date on which a driver is no longer affiliated with the company, and any subsequent company with which the driver becomes affiliated must provide a new notice pursuant to this section before allowing the driver to provide transportation services in affiliation with the company.
4. The failure to provide the notice required by this section before a driver is on call for the transportation network company, or providing false or inaccurate information in such a notice, may be grounds for the assessment of an administrative fine or the suspension or revocation of a permit pursuant to NRS 706A.300 and NAC 706A.380.
5. All records and files of the Authority that include information provided to the Authority pursuant to this section, including any lists compiled pursuant to subsection 3, are confidential and privileged and are not a public book or record within the meaning of NRS 239.010.
