N.H. Admin. Code § Ahp 209.02 - Procedure for Emergency Suspension of Licenses and Certifications
(a) Upon a finding that public health, safety
or welfare requires emergency action, the board shall immediately and prior to
a hearing suspend a license or certification by issuing a written order of
suspension incorporating the finding.
(b) The board shall commence a hearing no
later than 10 working days after the issuance of an order pursuant to (a)
above.
(c) Unless the 10-day
deadline in (b) above is expressly waived by the licensed or certified
individual, the failure of the board to meet the deadline shall result in the
automatic vacating of the order of suspension.
(d) After the vacating of the order pursuant
to (c) above, the board shall not again suspend the license or certification on
the basis of the same conduct which formed the basis for the vacated order
without giving the licensed or certified individual prior notice and the
opportunity for a hearing under
Ahp
209.01.
(e) The recording of a hearing on the
emergency suspension of a license or certification shall be made by a certified
shorthand court reporter provided and paid for by the board.
