N.H. Admin. Code § Dec 201.04 - Waiver of Rules
(a) Upon its own
motion, or upon written request, the committee shall waive the provisions of
any rule, except where precluded by statute, provided that:
(1) Such waiver will enable the committee to
either expedite the proceeding or complete the proceeding in a more orderly
manner;
(2) Compliance with the
rule would be onerous or inapplicable given the circumstances of the affected
person; or
(3) A specifically
defined alternative procedure is proposed which shall result in a substantially
equivalent result consistent with the principles embodied in said
rule.
