N.H. Admin. Code § Fam 215.01 - Settlements
(a) Any certified
family mediator or certified family mediator training program having a dispute
with the board shall have the opportunity at any time to settle some or all of
the issues.
(b) In the event of a
proposed settlement arising from a complaint against an individual or entity
certified by the board:
(1) The board shall
give the complainant 20 days to submit a written comment on the terms of the
proposed settlement; and
(2) When
finalizing the settlement, the board shall not be required to seek or receive
the approval of the complainant, but shall take into account any written
comment timely received from the complainant.
(c) To be effective, an agreement to settle
shall be:
(1) In writing and signed by the
certified family mediator or an authorized representative of the certified
family mediator training program; and
(2) Finalized as an order issued by the
board.
(d) The signing of
the agreement to settle shall constitute a waiver of the right to an
adjudicative hearing of the issues resolved by the agreement.
