N.H. Admin. Code § Saf-C 5606.03 - Definitions

For the purposes of this part, the following definitions shall apply:

(a) "Consent" means conduct, express or implied, affirming an agreement to transfer personal information to another.

(b) For the purpose of this section, "financial institution" means an organization in the business of holding financial assets, such as banks, investment companies, credit unions, savings banks, savings and loan associations, trust companies, building and loan associations or any depository institution as defined by the Federal Deposit Insurance Act, as amended, 12 U.S.C. section 1813(c)(1), doing business at a location in this state.

(c) "Recording" means anything on which images or data or both are fixed or registered, including images or data transferred, regardless of form.

(d) "Retain" means the routine collection and capture of data or images for purposes of creating a history or recall and access to the data.

(e) "Scanning" means the transfer or reading of information or an image located in a magnetic stripe or bar coding on the back of a driver license.

(f) "Store" means to preserve information or data in any medium for data collection, backup or archival purposes for an indefinite or definite period of time.
