REVISION NOTE:

Document #10064, effective 12-28-11, adopted Chapter Ph 1400 titled "Unused Prescription Drug Program Rules". Document #13435, effective 8-18-22, subsequently readopted, readopted with amendments, or repealed all of the rules in the former Chapter Ph 1400 and retitled the chapter as "Unused Prescription Drug and Medical Devices Program Rules". The amendments and repeals necessitated the renumbering of most of the remaining, existing rules within Chapter Ph 1400.

The rules filed in Document #10064 did not expire on 12-28-21 but were extended pursuant to RSA 541-A:14-a until replaced by the rules in Document #13435, effective 8-18-22.

Document #13435 readopted with amendments Part Ph 1401 titled "Purpose" and Part Ph 1402 titled "Definitions", including the insertion of the following new rules in Part Ph 1402:

Ph1402.08 defining "medical supplies"

Ph1402.09 defining "original packaging"

Ph1402.16 defining "unopened tamper-evident packaging"

The insertion of the new rules necessitated the renumbering of the existing Ph 1402.08 through Ph 1402.13 as Ph 1402.10 through Ph 1402.15. Document #13435 amended all of the existing definitions in Part Ph 1402 except for the definitions of "agent", "pharmacy", "practitioner", and "uninsured" which remained unchanged except for the renumbering of "pharmacy" from Ph 1402.08 to Ph 1402.10, "practitioner" from Ph 1402.09 to Ph 1402.11, and "uninsured" from Ph 1402.13 to Ph 1402.15.

Document #13435 also readopted with amendments Part Ph 1403, titled "Eligibility to Donate Prescription Drugs (EDP) and Medical Devices", and retitled it as "Eligibility to Donate, Accept, and Redispense Prescription Drugs and Medical Devices". The existing rules Ph 1403.01 through Ph 1403.03 were replaced by Ph 1403.01 through Ph 1403.04. The former Ph 1403.01 titled "Eligible Donating Entities" was amended and renumbered as Ph 1403.02 titled "Eligible Entities".

Document #13435 readopted with amendments Part Ph 1404, titled "Eligibility to Accept Donations (EAD)", and retitled it as "Responsibility for Charitable Providers." The existing Ph 1404.01 titled "Eligible Accepting Entities" was deleted and replaced by Ph 1404.01 titled "Charitable Providers."

Document #13435 readopted with amendments Part Ph 1405, titled "Eligibility to Redispense" and retitled it as "Dispensing Requirements". The existing rule Ph 1405.01 titled "Eligible Redispensing Facilities" was deleted and replaced by rules Ph 1405.01 through Ph 1405.03.

Document #13435 readopted with amendments Part Ph 1410, titled "Forms", retitled it as "Forms and Recordkeeping Requirements", and renumbered it as Part Ph 1406. Part Ph 1411 titled "Participant Immunity" and Part Ph 1412 titled "Violations" were readopted and renumbered as Part Ph 1407 and Part Ph 1408, respectively.
