N.J. Admin. Code § 1:1-16.2 - Time of motion
(a) A
motion for leave to intervene may be filed at any time after a case is
initiated.
(b) If made before a
case has been filed with the Office of Administrative Law, a motion for leave
to intervene shall be filed with the head of the agency having jurisdiction
over the case. The agency head may rule upon the motion to intervene or may
reserve decision for action by a judge after the case has been filed with the
Office of Administrative Law.
(c)
If made after a case has been filed with the Office of Administrative Law, a
motion for leave to intervene shall be filed with the judge or, if the case has
not yet been assigned to a judge, with the Clerk of the Office of
Administrative Law.
