N.J. Admin. Code § 1:1-7.5 - Filing by facsimile transmission
(a) A
paper may be filed by facsimile transmission unless prohibited by the
judge.
(b) Facsimile transmissions
must comply with all requirements of this subchapter except
N.J.A.C.
1:1-7.3(c) and
1:1-7.4(b).
(c) The party filing a document by facsimile
transmission must include a certification indicating the method of service upon
each party and stating that the original document is available for filing if
requested by court or a party.
(d)
Facsimile transmittals are filed as of the date of receipt by the Clerk or the
judge, provided that the complete transmittal is received by 5:00 P.M.
Facsimile transmittals received after 5:00 P.M. shall be deemed to be filed as
of the next business day.
(e) A
party requesting a facsimile transmittal from the Clerk or the judge shall be
assessed a charge at the rate provided in the Open Public Records Act,
N.J.S.A. 47:1A-1 et seq.
