N.J. Admin. Code § 1:6A-14.1 - Procedures for hearing
(a) To
the greatest extent possible, the hearing shall be conducted at a time and
place convenient to the parent(s) or guardian.
(b) At the hearing, parents shall have the
right to open the hearing to the public, and to have the child who is the
subject of the hearing present.
(c)
A verbatim record shall be made of the hearing.
(d) The judge's decision shall be based on
the preponderance of the credible evidence, and the proposed action of the
board of education or public agency shall not be accorded any presumption of
correctness.
