N.J. Admin. Code § 10:161B-8.1 - Provision of nursing services
(a) Nursing services shall be provided in
licensed outpatient substance *[abuse]* *use disorder* treatment programs as follows:
1. Outpatient, intensive outpatient, and partial care programs are not
required to provide nursing services in treatment facilities offering these services. Outpatient, intensive
outpatient and partial care programs shall comply with (b) below.
2. Opioid treatment and opioid detoxification programs shall appoint a
director of nursing services and shall provide nursing services on site. The director of nursing services or
designee shall be on premises during normal business hours and whenever medications are being administered.
i. The designee for the director of nursing services shall be a registered
professional nurse (RN).
(b) In OP, IOP, or
PC facilities, where nursing services are not required and not provided, the substance abuse counselor to
whom the client is assigned or another designated staff person identified by the director of substance abuse
counseling services, shall obtain health related information from the client and shall record the information
in the client record.
1. Health related information shall include, but not
be limited to:
i. Significant medical history;
ii. Hospitalizations;
iii.
Treatments;
iv. History of communicable disease;
v. Most recent Mantoux test and results;
vi. Risk of Hepatitis B and HIV exposure;
vii. Pregnancies and sexually transmitted diseases; and
viii. Any current symptomatology.
2. If the substance abuse counselor or another designated staff person
determines that there is an indication for medical treatment or screening, the substance abuse counselor or
another designated staff person shall coordinate referral for medical services as determined by a written
protocol using either on-site or affiliated medical services. Resolution of health related problems shall be
included as part of the comprehensive treatment plan and all referrals or treatment, and shall be documented
in the client chart.
