N.J. Admin. Code § 11:21-2.15 - Amendment and termination
(a) This Plan may
be amended by a majority vote of the entire Board , subject to approval of the
Commissioner as provided hereinafter. A vote on an amendment may be taken at
any meeting called, in whole or in part, for the purpose of considering a
proposed amendment. Written notice of any meeting at which an amendment to the
Plan is to be considered shall be sent to each Director by mail, electronic
mail, or facsimile transmission at least 10 days (exclusive of the meeting day)
prior to the date of the meeting. Such notice shall state that an amendment to
the Plan is to be considered at the meeting and shall set forth the substance
of any amendments which have been proposed or a description of the section or
sections which are proposed to be amended. Notice to a Director shall be deemed
sufficient if mailed, postage prepaid, to the most recent address provided by
the Director to the Board or sent by facsimile transmission to the most recent
facsimile reception number provided by the Director or sent by e-mail to the
e-mail address provided by the Director. At any meeting for the consideration
of an amendment to the Plan, for which proper notice has been given pursuant to
this section, the Board may vote on any amendment proposed by a Director prior
to, or during the meeting. Any amendment adopted by the Board shall be
submitted to the Commissioner for approval. Any such amendment submitted to the
Commissioner shall be deemed approved no later than 90 days after receipt by
the Commissioner unless expressly disapproved in writing by the Commissioner
before expiration of the approval period. Amendments to the Plan must be
adopted pursuant to P.L. 1993, c.162.
(b) The Program shall continue in existence
subject to termination in accordance with the laws of this State or the United
States of America. In case of enactment of a law or laws which, in the
determination of the Board and the Commissioner , shall result in the
termination of the Program , the Program shall terminate and conclude its
affairs. Any funds or assets held by the Program following the payment of all
claims and expenses of the Program shall be distributed to the members at that
time in accordance with the then-existing assessment formula.
