N.J. Admin. Code § 14:17-6.20 - Petitions by municipalities for permission to charge franchise fee above that prescribed at N.J.S.A. 48:5A-1 et seq
(a) Petitions by
municipalities for permission to charge a franchise fee above that prescribed
at N.J.S.A. 48:5A-1 et seq., shall be
filed in one of two forms:
1. A municipal
consent, included by a cable television company in its petition for Certificate
of Approval, will be considered a petition for permission to charge a franchise
fee in excess of that prescribed in
N.J.S.A.
48:5A-1 et seq.; or
2. A petition in conformity with the
requirements at N.J.A.C. 14:17-4, 6.1, 6.2, 6.3, and 6.4, to the extent
applicable, may be filed separately by a municipality.
3. Additionally, a municipality shall be
required to provide the following information:
i. Proof that the expenses to the
municipality with respect to the regulation or supervision caused by the
existence and operation of the cable television company is warranted;
ii. Proof that the municipality has given
notice of its filing to the affected cable television
company.
