N.J. Admin. Code § 3A:51-3.3 - Confidentiality of records
(a) Each resource
family parent file maintained by the Department of Children and Families shall
be confidential to protect the safety and welfare of the children and resource
family parents and shall not be part of the public record, in keeping with the
Open Public Records Act,
P.L.
2001 , c. 404 , and other
applicable statutes and rules. The Department may issue statistical reports
depicting resource family home licensing activity that are part of the public
record, but such reports shall not contain any identifying information on any
individual child or resource family home.
(b) The resource family parent shall be bound
by the same standards of confidentiality regarding a child in placement, and
the child's family, as the Department and its employees. These standards shall
include, but are not limited to, the following:
1. The resource family parent shall not
permit a child in placement to appear in any media publication or report
without the express consent of the parent or Department
representative.
2. The resource
family parent or household member shall not discuss any confidential
information about the child in placement with a friend, neighbor, non-household
member or other individual who is not involved with the child's care, education
or treatment.
