N.J. Admin. Code § 7:7A-19.8 - Cancellation of an application
(a) The Department shall cancel an
application for any of the following reasons:
1. An applicant does not submit additional
information within the time frame prescribed by the Department under this
subchapter for an application that has been determined to be administratively
or technically incomplete;
2. The
applicant does not submit a fee required under
N.J.A.C.
7:7A-18, or the Department cannot collect the
fee for any reason (for example, if a check is returned for insufficient
funds); or
3. The applicant does
not comply with the applicable public notice requirements at
N.J.A.C.
7:7A-17.
(b) To cancel an application, the Department
shall:
1. Send the applicant a written notice
of its intent to cancel the application and notifying the applicant that the
fee and/or additional information identified pursuant to (a) above must be
provided to the Department within 15 calendar days.
2. If, by the 15-calendar-day deadline, the
applicant submits a written statement providing good cause for the delay in
providing the fee and/or additional information, the Department shall extend
the time required for submittal.
3.
If the applicant does not submit the fee and/or additional information, or a
statement of good cause for delay under (b)2 above, the Department shall cancel
the application and send the applicant a written notice of the
cancellation.
