N.J. Admin. Code § 7:7A-21.3 - Effect of request for hearing on operation of permit or authorization
(a) When a
permittee requests an adjudicatory hearing to appeal any portion of a permit or
an authorization, the operation of the permit or authorization shall be
automatically stayed in its entirety, unless the permittee shows good cause in
writing why the permit or authorization should continue in effect while being
contested. All permitted activities shall stop as of the date the hearing
request is submitted, and shall not be started again until the matter is
resolved, unless the Department grants an exception in writing.
(b) When a person other than the permittee
requests an adjudicatory hearing on a permit or authorization, the operation of
the permit or authorization is not automatically stayed. The Department shall
stay operation of the permit or authorization only if it determines that good
cause to do so exists. If a stay is imposed, all permitted activities shall
stop as of the date the stay is imposed, and shall not be started again until
the matter is resolved, unless the Department grants an exception in
writing.
