N.J. Admin. Code § 10:44C-5.3 - Psychotropic medication

(a) Within two weeks after admission, the licensee shall document that the licensee attempted to obtain, for persons receiving psychotropic medication, a clinical assessment by a physician or advanced practice nurse.
(b) The licensee shall assure that the following provisions are implemented regarding the administration of psychotropic medication in an emergency:
1. Short acting injectable psychotropic medication used in emergencies shall be administered only by a licensed physician or a licensed nurse.
2. In an emergency, telephone orders shall be permitted provided they are signed by the physician or advanced practice nurse within 24 hours.
3. The person served shall be monitored continuously by agency staff trained to observe for side effects.
4. The licensee shall assure that the person served is seen by the physician or advanced practice nurse within 48 hours of the administration of the injectable medication.
5. When a psychotropic medication is prescribed and administered in an emergency, the TDT shall meet to review the use of the psychotropic medication within five working days in order to report observations to the prescribing physician or advanced practice nurse.
i. The results of the review shall be recorded in the record of the person served.
(c) Psychotropic medication shall not be used for punishment, for the convenience of staff or as a substitute for a rehabilitative treatment environment.
(d) The use of psychotropic medication shall be documented in the ITP.
1. The TDT shall review the efficiency of psychotropic medication at least on a quarterly basis and report the findings to the prescribing physician or advanced practice nurse.
i. The results of the review shall be recorded in the record of the person served.
ii. Concerns of the TDT shall be referred to the physician or advanced practice nurse, the Behavior Management Committee and the Human Rights Committee, as necessary.
(e) The licensee shall comply with the requirements of 10:44C-5.2(a) and (b) in the provision of training or assistance to persons served in administering psychotropic medication.
(f) The licensee shall comply with the requirements of 10:44C-5.2(c) through (g) regarding records and documentation pertaining to psychotropic medication.
(g) The licensee shall comply with 10:44C-5.2(h) regarding psychotropic medication.
(h) The licensee shall ensure that psychotropic medication is stored as specified at 10:44C-5.2(i).
(i) The licensee shall ensure that each staff member involved in the administration of psychotropic medication receives the following training:
1. Indications for drug use; and
2. Therapeutic effects and side effects.
