N.M. Code R. § 6.29.1.10 - WAIVERS
A. To obtain a
waiver from the department for procedural or program requirements, a district
superintendent or the administrator of a state-chartered charter school shall
submit a request to the secretary, in the manner required by the department,
with justification for the change. The request and the response shall be kept
on file by the district or charter school and the department, and these records
shall be available for review by the public.
B. The secretary may waive a graduation
requirement for a student based upon the written request of the superintendent
or the administrator of a state-chartered charter school, using the
department's graduation waiver request form. This form shall include: name of
superintendent; district/school; mailing address; phone; fax; email address;
name of a secondary contact person including the same information; date of
submission; local board policy requirement and approval, if required; date of
board approval; statement of applicable district or charter school policy and
rationale for request.
C. No other
waivers of provisions of the Public School Code shall be permitted unless
authorized by law.
