N.M. Admin. Code § 19.2.8.13 - RELINQUISHMENT
A. With the prior
written consent of the commissioner, the release of all outstanding collateral
assignments, and the payment to the commissioner of the relinquishment filing
fee as set forth in the schedule of fees, any lessee may relinquish to the
state a lease that is not in default and the lease shall be cancelled.
(1) The relinquishment filing fee shall be
waived if the relinquishment is at the request of the commissioner.
(2) Relinquishments shall be made on forms
and in the manner prescribed by the commissioner.
B. A relinquishment without the written
consent of the commissioner shall be null and void.
