N.M. Admin. Code § 8.321.10.16 - NONCOMPLIANCE WITH REGULATIONS
A.
If an inspection conducted by the HCA shows that an OTP is not in compliance
with these regulations, the HCA shall deliver to the program a written notice
of the deficiencies identified.
B.
The program shall respond to the notification of deficiencies within 30 days of
the notification. The program response shall include a corrective action plan
together with timeline for implementation, or an explanation, satisfactory to
the HCA, of the reason for any deviations from the requirements of these
regulations.
C. Failure of the OTP
to respond within 30 days of receipt of the notification of deficiencies shall
be grounds for immediate suspension of the approval.
