N.Y. Comp. Codes R. & Regs. Tit. 12 § 21.2 - Definitions
As used in or in connection with this Part, the following terms mean:
(a) Anchor. Window
cleaners' safety anchor.
(b)
Approved. In compliance with a subsisting resolution of approval adopted by the
board.
(c) Authorized. Specified by
rule or resolution of the board for use in complying with the provisions of
this Part.
(d) Industrial Board of
Appeals. The New York State Board of Standards and Appeals.
(e) Cleaner. A person doing the actual work
of cleaning a window.
(f)
Commissioner. The Industrial Commissioner of the State of New York.
(g) Extension device. A hand tool used to do
window cleaning on surfaces beyond the normal reach of the window
cleaner.
(h) From the inside. From
a position in which all of the cleaner's body except one arm is interior to the
window sash.
(i) From the outside.
From a position in which more of the cleaner's body than one arm is exterior to
the window sash.
(j) Owner. The
owner of a public building which is subject to the provisions of section
202 of the Labor Law,
or the lessee of the whole thereof, or the agent, manager or superintendent in
charge of the property.
(k) Public
building. Public building shall include a factory building, an office building,
a mercantile building, a hotel building, a theatre building, a warehouse
building, an apartment building, a State or municipal building, a school, a
college or university building, a building containing a place of public
assembly maintained or leased for pecuniary gain, or any other building more
than one story high except a dwelling house less than three stories high or
occupied by less than three families. (Labor Law, §2, subd. 13.)
(l) Shall. The word shall is always
mandatory.
(m) Unobstructed.
Unobstructed during window cleaning operations.
(n) Window. A window installed in a public
building which is subject to the provisions of section
202 of the Labor
Law.
