N.Y. Comp. Codes R. & Regs. Tit. 12 § 39.9 - Location of magazines
(a)
Quantity and distance tables.
(1)
The following tables show the distances from nearest buildings, railroads or
highways, as these terms are defined in article 16 of the Labor Law, that the
respective quantities and types of explosive materials may be stored.
(2) For the purpose of compliance with this
Part (rule), the weight of finished fireworks shall be considered as the weight
of explosive materials stored in a magazine.
(3) The following distances in Table 1, "High
Explosives Quantity and Distance Table," may be reduced by one half when the
building, railroad or highway to be protected is effectively screened from the
explosives factory or magazine by an efficient barricade as defined in article
16 of the Labor Law.
(4) The board
may authorize temporary deviations from the following quantity and distance
tables when compliance therewith entails practical difficulties or unnecessary
hardship, provided public safety is preserved.
