N.Y. Comp. Codes R. & Regs. Tit. 12 §§ 45-4.3 - Special requirements

(a) Exits. At least two exits remote from each other shall be provided from each floor, tier, room or balcony in a building or structure to which this Subpart applies. No exit shall be less than 18 inches wide.

(b) Exit signs.

(1) Location. Low level exit signs visible from the approach to the exits, shall be provided at each exit doorway from the building or structure. The bottom of the low level exit signs shall not be less than six inches nor more than eight inches above the floor.

(2) Illumination. Such signs shall be illuminated either externally or internally by artificial light and shall be kept illuminated at all times when the building is occupied.

(3) Legend requirements. Each low level exit sign shall be worded in plainly legible block letters, at least six inches high with three-quarter inch strokes, with the word EXIT.

(c) Exit directional signs and exit path marking.

(1) Location. Exit directional signs shall be provided at locations in hallways, passageways, corridors, aisles and at all other locations from which exit doorways are not readily discernible. Low level exit path marking shall be allowed in lieu of exit directional signs.

(2) Illumination. Such signs or exit path marking shall not normally be illuminated; however, in the event of activation of the emergency lighting system required by subdivision (d) of this section, these signs or exit path marking shall be illuminated by this system.

(3) Legend requirements. Exit directional signs shall be worded as in paragraph (b)(3) of this section with a suitable pointer or arrow indicating the direction of exit.

(4) Low level exit path marking placement. The low level exit path marking shall be located at floor level or no more than eight inches above the floor level on or near the exit path.

(d) Emergency lighting. Each building or structure shall be equipped with an emergency lighting system conforming to the requirements of Part 1032, of Title 9 NYCRR "Emergency Power and Lighting," of the New York State Uniform Fire Prevention and Building Code, effective January 1, 1984. In addition, the emergency lighting system shall be automatically activated by the operation of the fire and smoke detection system required under subdivision (e) of this section.

(e) Fire and smoke detection system. Each building or structure shall be equipped with a fire and smoke detecting system conforming to the requirements of section 1060.3, Part 1060, Title 9 NYCRR "Fire- and Smoke-Detecting Systems," of the New York State Uniform Fire Prevention and Building Code, effective November 15, 1985. In addition, this system shall have the capability of activating the emergency lighting system required by subdivision (d) of this section.

(f) Fire prevention and protection. Each building or structure shall conform to the provisions of section 45-2.23 of this Part.

(g) Smoking prohibited. The carrying of lighted cigars, cigarettes or pipes shall be prohibited in any building or structure subject to the provisions of this Subpart. NO SMOKING signs shall be posted at all entrances to such building or structure.

(h) Evacuation procedures. The owner shall develop emergency evacuation procedures for each building or structure. Such procedures shall be in writing and shall be available on site for review by the commissioner or his authorized representative and any personnel assigned to the operation of the building or structure. The owners shall also insure that all personnel assigned to the operation of the building or structure are thoroughly trained in the implementation of these evacuation procedures.
