N.Y. Comp. Codes R. & Regs. Tit. 15 § 136.8 - Effect of application denial
Denial of an application for license shall be appealable to the Administrative Appeals Board, except that the appeals board shall not consider any material which had not been previously submitted. In such a case, the applicant shall be required to submit any additional material in a new application.
