N.Y. Comp. Codes R. & Regs. Tit. 2 § 110.5 - Copying of records
Records containing trade secrets, information that would cause competitive injury, and critical infrastructure information.
(a) Any person who submits records to the
Department that contain:
(1) trade secret
information;
(2) information
pertaining to a commercial enterprise that would cause substantial injury to
the competitive position of the subject enterprise if disclosed; or
(3) critical infrastructure information may,
at the time of submission, request that the department except those records or
portions thereof from disclosure as provided for by paragraph (d) of
subdivision two of section
87 of the
Public Officers Law.
(b)
A request for an exception shall be in writing, accompany the records, and
state the reasons why the records or portions thereof should be excepted from
disclosure.
(c) Division staff
shall take appropriate measures to ensure only authorized access.
