N.Y. Comp. Codes R. & Regs. Tit. 9 § 6404.3 - Eligibility
(a) An organization
shall be eligible to apply for financial assistance if it:
(1) is a current applicant to the council for
funding under one or more of the council's other funding programs;
(2) has received funding from the council in
each of the prior three State fiscal years;
(3) is not approved for financing for the
project from any other State assistance program during the current fiscal year
in which the application is made; and
(4) can demonstrate:
(i) ownership of a condominium, a building or
part of a building;
(ii) ownership
of shares representing a cooperative interest in a building;
(iii) possession of a lease-purchase interest
in a building or part of a building; or
(iv) possession of a lease in a building or
part thereof having an unexpired term of five years or an unexpired term of
three years with an option to renew such lease for an additional term of two
years or more.
(b) No organization shall be eligible to
receive financial assistance for more than three years in any consecutive
five-year period.
(c) Applications
of eligible public universities, their components and affiliate organizations
shall not be considered by the council prior to December 31st in any State
fiscal year.
