N.Y. Comp. Codes R. & Regs. Tit. 9 § 8008.7 - Denial of access to records
(a) Denial of access to records shall be in
writing and shall:
(1) state the reasons for
denial;
(2) advise the requestor of
his right to appeal the denial to the counsel of the division; and
(3) advise the requestor that he must apply
for an appeal within 30 days of the receipt of the denial of access.
(b) If the records access officer
fails to respond to a request for information within five workdays of the
receipt of the request, the failure to respond shall be deemed a denial of
access.
(c) If a request is not
acted upon within 10 workdays after the date of acknowledgement of the receipt
of a request, the failure to act may be construed as a denial of
access.
