02 N.C. Admin. Code 38 .0203 - TYPE APPROVAL OF WEIGHING AND MEASURING DEVICES
(a)
Each type or model or pattern or design of weight or measure or weighing or
measuring device intended for use in trade in this state, generally known as
commercial use, shall first be submitted or demonstrated by the manufacturer
for the purpose of approval, and be approved by the Director of the Standards
Division at Raleigh, North Carolina, or such other place as agreed upon, in
accordance with National Institute of Standards and Technology (NIST) Handbook
44, "Specifications, Tolerances, and Other Technical Requirements for Weighing
and Measuring Devices". The expense incurred in obtaining approval shall be
borne by the manufacturer in accordance with
G.S.
81A-10.
(b) The Director may accept in lieu of the
requirement in (a) of this Rule, a Certificate of Conformance issued by the
National Conference of Weights and Measures.
