Ohio Admin. Code 122:12-2-01 - Definitions

This version is in effect until 10/31/2010

Definitions as used in this chapter:

(A) "Agreement" means the agreement to be entered into by and between the director and each electric distribution utility, participating municipal electric utility, electric cooperative or other designated supplier which will set forth specific provisions that shall govern the relationship between the two entities.
(B) "Authorized provider" means any contractor or grantee.
(C) "Commission" means the public utilities commission of Ohio.
(D) "Competitive retail electric service," for the purposes of this chapter, means a component of retail electric service, usually generation, that is competitive as provided under division (B) of section 4928.01 of the Revised Code.
(E) "Contractor" means any authorized provider that is a for-profit business or organization supplying energy efficient products or services, or any company or individual providing direct service to the director, pursuant to written contract, in carrying out its administration of the fund including, but not limited to evaluation consultants, system design professionals and program design consultants.
(F) "Crediting arrangements and responsibilities" for the purposes of this chapter means the procedures for crediting to the percentage of income payment plan program customer's account the amount of the percentage of income payment plan program payment received for current residential competitive and noncompetitive retail electric services.
(G) "Customer" for the purposes of this chapter, means any person who has an agreement by contract or tariff with an electric distribution utility to receive electric distribution service
(H) "Director" means the director of the Ohio department of development, and also includes such other officers or employees of the Ohio department of development as may act for or in place of the director under this chapter pursuant to rule 122:12-2-08 of the Administrative Code.
(I) "Electric cooperative" means a not-for-profit electric light company that both is or has been financed in whole or in part under the "Rural Electrification Act of 1936," 49 stat. 1363, 7 U.S.C. 901, and owns or operates facilities in the state of Ohio to generate, transmit, or distribute electricity, or a not-for-profit successor of such company.
(J) "Electric distribution utility" means an electric utility that supplies at least retail electric distribution service.
(K) "Electric services company" shall have the same meaning as set forth in section 4928.01(A)(9) of the Revised Code.
(L) "Electric utility" shall have the same meaning as set forth in section 4928.01(A)(11) of the Revised Code.
(M) "Fund" means the universal service fund, into which all universal service revenues remitted to the director are deposited.
(N) "Grantee" means any authorized provider that is a not-for-profit company, local community based organization created pursuant to section 501(C)(3) of the Internal Revenue Code, or a unit of local government engaged in the provision of (1) energy assistance, (2) energy efficiency products or weatherization services to customers eligible for assistance under a specified low-income customer assistance program; (3) providers of consumer education services; and (4) organizations providing direct service to the director, pursuant to a grant agreement with the director to administer the fund, including, but not limited to, evaluation consultants, system design professionals and program design consultants.
(O) "Internal Revenue Code" means the "Internal Revenue Code of 1986", 100 stat. 2085, 26 U.S.C. 1 et seq., as amended from time to time, and includes any laws of the United States providing for application of that code and the applicable regulations or rulings thereunder, including temporary and proposed regulations.
(P) "Low-income customer assistance programs" means the percentage of income payment plan program, the home energy assistance program, the home weatherization assistance program, the Ohio energy credit program, and the targeted energy efficiency and weatherization program.
(Q) "Municipal electric utility" means a municipal corporation that owns or operates facilities to generate, transmit, or distribute electricity.
(R) "Noncompetitive retail electric service" means a component of retail electric service, usually transmission and distribution services, that has not been declared competitive by the Ohio legislature or by the commission under division (B) of section 4928.01 of the Revised Code. For the purposes of this chapter, noncompetitive retail electric service also means retail electric generation services provided by an electric distribution utility beginning September 1, 2000, until replaced by the provision of competitive retail electric service for the percentage of income payment plan program by a winning bidder.
(S) "Office of energy efficiency" means the office within the Ohio department of development, designated as the state energy office for purposes of receiving federal funding from the United States department of energy.
(T) "Payment arrangements and responsibility policies" for the purposes of this chapter, mean those procedures set forth in paragraph (B) of rule 4901:1-18-04 of the Administrative Code.
(U) "Percentage of income payment plan program" for the purposes of this rule, has the same meaning as an extended payment plan described in paragraph (B) of rule 4901:1-18-04 of the Administrative Code.
(V) "Percentage of income payment plan program customer" means a customer who participates in the percentage of income payment plan program.
(W) "Percentage of income payment plan program arrearages" means the personal debt of a percentage of income payment plan program customer owed to an electric distribution utility prior to September 1, 2000.
(X) "Primary source of heat" has the meaning as set forth in paragraph (F) of rule 4901:1-18-02 of the Administrative Code.
(Y) "Secondary source of heat" has the meaning set forth in paragraph (G) of rule 4901:1-18-02 of the Administrative Code.
(Z) "Universal service rider" means the rider on retail electric distribution service as determined by the commission pursuant to Chapter 4928. of the Revised Code.
(AA) "Weatherization program standards" means a set of standards developed and maintained by the office of energy efficiency, which related to the installation of weatherization materials and energy efficiency products and services, to measure and evaluate the performance of materials and services provided, as amended, which is attached as an appendix to this rule.

Appendix 1 UNIVERSAL SERVICE FUND Sub-set of WEATHERIZATION PROGRAM STANDARDS

Attached are the sections of the Weatherization Program Standards (WPS) that relate to the Universal Service Fund (USF) Baseload Services. These sections deal only with baseload energy use, which is described as non-heating, non-cooling energy use. Baseload use is defined as lighting, refrigeration, cooking, laundry equipment, dishwashing equipment, and other miscellaneous electrical uses. Electrically fueled domestic hot water is also included.

Weatherization measures are those measures that impact the heating and cooling load on the building. Insulation, air sealing of the building shell or duct system and heating or cooling equipment efficiency improvements are included in weatherization measures.

It is important to understand that any activities that impact the air tightness of the structure may impact the operation and venting of combustion appliances and therefore can not be separated from the WPS. One of the guiding principles used to form the WPS is the concept of the "House as a System" which is the importance of dealing with the interaction of measures. The one area were interaction of measures is not critical is the baseload measures and thus we are able to allow those requirements to stand-alone. The effects of insulating, air sealing, and duct sealing will have impacts on the building shell, combustion appliances, and indoor air quality and therefore the safety aspects of the WPS must be enforced. Because these concepts are integral to the WPS, the full standards must be used to assure client health and safety.

The Office of Energy Efficiency regularly makes improvements to these standards by a public process. While the sections that deal with baseload efficiency measures have been extracted for the purpose of this filing, OEE in no way intends that these standards be allowed to be changed, or the full WPS be allowed to be changed separately. These standards and the full WPS must remain linked, through the process defined in the Review Adoption Cycle, Section 105, Administration. Initial inspection procedures

Electric power supply 201- 4.2

201- 4.2 a main power supply

Inspect the main electrical power supply to an electric tank to determine that it is safe.

201- 4.2 b dedicated circuit

Inspect the wiring to the DHW unit and determine whether the electric line to the DHW is a dedicated circuit that is properly sized and fused. If no dedicated circuit exists, it is not necessary to install one unless, the wiring is in poor condition, or if there is a history of circuit failure, or if the unit is to be replaced.

201- 4.2 c hazardous wiring

Visually inspect the wiring at or in the DHW unit to detect charred, frayed or missing insulation and improper or loose connections. If the wiring is hazardous, inform the customer of the problem and have the problem corrected.

Water tank condition 201- 4.7

201- 4.7 a tank leakage

Determine if the tank is leaking. If it is leaking, it may be replaced using Health and Safety funds.

201- 4.7 b pressure relief valve/discharge pipe

Determine whether the discharge pipe/pressure relief valve is present. If the discharge pipe/pressure relief valve is not present, and there is an existing location for them, have them installed. If the discharge pipe/pressure relief valve is not present, and there is not an existing location for them, install them in the hot water line.

201- 4.7 c tank insulation warning

Do not call for insulation on a DHW that has a manufacturer's warning against adding insulation to the tank.

201- 4.7 d tank insulation

Determine whether the tank is insulated. Measure the tank to determine the amount of insulation necessary to cover the tank.

201- 4.7 e temperature setting

Examine the temperature setting on the thermostat(s). Consult with the customer to determine if lowering the temperature can be accomplished without affecting the life style of the customer.

DHW distribution 201- 4.8

201- 4.8 a water line insulation

Determine whether there is insulation present on the first six feet of both the hot and cold water lines.

Fluorescent lighting 201- 7.1

201- 7.1 a survey existing lighting

Survey and note all interior lighting fixtures. Note the location, existing wattage and number of bulbs per fixture. Interview the customer to determine the hours per day the fixture is on..

201- 7.1 b determine replacements

Using the information gathered and the replacement chart (reference 1506-6), determine which bulbs may be replaced and note that on the inspection form.

201- 7.1 c customer needs

The customer's specific needs and habits must be considered in the replacement decision. Light quality (lumens) must not be compromised. Fluorescent bulbs must not be installed in fixtures equipped with dimmers unless the bulb manufacturer specifically allows for it.

Lumen output at the lamp should be sufficient to assure these illuminance levels at the working surface.

Lumen output is measured at 1 foot from the source and is the total output in all directions. Foot-candles measured at the surface considers light output, distance from the light source and reflectance of the surrounding surfaces.

201- 7.1 d consumer education

Consumer education must be provided concerning matters such as:

a. Fluorescent bulbs are most cost-effective in applications where the light remains on for long periods of time.

b. Fluorescent bulbs may take 60-90 seconds to reach full brightness.

c. Fluorescent bulbs last approximately 10 times longer than incandescent bulbs and are therefore beneficial in hard to reach places.

d. Fluorescent bulbs are applicable where safety is an issue, such as fixtures where incandescent bulbs exist that are overrated for the wattage of the fixture and therefore create a fire hazard.

Other electric energy efficiency measures (EEMs) 201- 7.2

201- 7.2 a measures

All electrical efficiency measures paid for using HWAP dollars must have a material cost of $150 or less. Savings potential must be documented and usage levels of the pre-existing condition should be metered if at all possible. Electrical efficiency measures paid for using Non-HWAP funds must meet the applicable cost-effectiveness test described in 1506-6.

Typical electrical efficiency improvements include repairs to water well pumps and lines, foam waterbed insulation covers, and repairs to timers on septic aerators.

Consumer energy education 201- 7.3

201- 7.3 a consumer energy education

Education should be provided concerning such matters as the impact of dirty filters on electric clothes dryers, the impact of dirty coils on refrigerators and freezers, etc.

Required electric energy efficiency measures 201- 7.4

201- 7.4 a required electric energy efficiency measures

a. For any heated waterbed, add (or have the customer add) a foam insulation blanket directly above the water filled mattress.

b. Replace or convert any Halide torchiere lamp with a fluorescent torchiere.

Refrigerator/freezer replacement 201- 7.5

201- 7.5 a survey existing appliances

Survey and note each existing refrigerator and freezer. Note the location of each existing appliance and meter the appliance wattage for at least 2 hours.

201- 7.5 b determine replacements

Using the information gathered during the inspection and the replacement chart (reference 1506-6), determine which appliances(s) can be replaced and note that on the inspection form.

201- 7.5 c customer needs

The customers' specific needs and habits must be considered in the replacement decision. Observe the existing appliance and discuss with the customer whether downsizing of the replacement appliance is appropriate.

201- 7.5 d recycle old units

Refrigerator and freezers taken out of service must be discarded in an environmentally-sensitive manner. Old appliances contain refrigerant gasses that must be reclaimed only at licensed stations. No appliances taken out of service may be returned to service by sale, barter, or given away for free. Disposal/recycling costs are to be added to the replacement cost and considered in the cost-effectiveness testing.

Installation procedures

301- 4.2 a main power supply

Repair or replace the main electrical power supply to an electric tank if it is unsafe.

301- 4.2 b dedicated circuit

Install a properly sized and fused dedicated circuit to the DHW if one is necessary, based on the wire conditions, the history of circuit failure, or if the unit is to be replaced.

301- 4.2 c hazardous wiring

Replace any wiring at or in the DHW unit that is charred, frayed or missing insulation. Correct any improper or loose connections. Replace or repair any defective wiring in, or leading to the DHW in accordance with NFPA 70, the National Electric Code.

Water tank condition 301- 4.7

301- 4.7 a tank leakage

Replace the tank if it is leaking. It may be replaced using Health and Safety funds.

301- 4.7 b pressure relief valve/discharge pipe

If the discharge pipe/pressure relief valve is not present, and there is an existing location for them, install them. If the discharge pipe/pressure relief valve is not present, and there is not an existing location for them, install them in the hot water line.

301- 4.7 c tank insulation

Insulate the DHW unless there is a manufacturer's warning against adding insulation to the tank. Do not insulate the tank if there is not a pressure relief valve and there is no way to add one.

301- 4.7 e temperature setting

If called for on the job order, lower the temperature setting.

DHW distribution 301- 4.8

301- 4.8 a water line insulation

Insulate the first six feet of both the hot and cold water lines with foam or fiberglass insulation.

Fluorescent lighting 301- 7.1

Install screw-in compact fluorescent lighting per manufacturer's instructions in the fixtures determined during the initial inspection. Never install fluorescent lighting in fixtures with dimmers unless specifically allowed by the bulb manufacturer .

Refrigerator/freezer replacement 301- 7.2

301- 7.2 a Install refrigerators/freezers

Install refrigerators/freezers per manufacturer's instructions in a location acceptable to the customer.

301- 7.2 b recycle old units

Refrigerator and freezers taken out of service must be discarded in an environmentally sensitive manner. Old appliances contain refrigerant gasses that must be reclaimed only at licensed stations. No appliances taken out of service may be returned to service by sale, barter, or given away for free. Disposal/recycling costs are to be added to the replacement cost and considered in the cost-effectiveness testing.

Other electric energy efficiency measures 301- 7.3

301- 7.1 a improvements

The customers specific needs and habits must be considered in the repair or replacement of efficiency measures. All meterial installed must be installed PMI and in compliance with local codes.

Required measures 301- 7.4

Foam waterbed covers must be purchased with non-HWAP funds. The waterbed cover shall be installed to cover the entire exposed surface of the mattress. The foam must be placed directly on the mattress surface, under any and all covers. The thermostat temperature for the appliance must be lowered at the time of installation of the insulation. Normal operating temperature with the foam in place should be between 70 and 80 degrees F.

Final inspection procedures

Electric power supply 401- 4.2

401- 4.2 a main power supply

Determine that the main electrical power supply to the electric tank is safe.

401- 4.2 b dedicated circuit

Ensure that the electric line to the DHW is a dedicated circuit that is properly sized and fused.

401- 4.2 c safe wiring

Ensure the wiring to the DHW is not charred, frayed or missing insulation and improper or loose connections have been corrected.

Water tank condition 401- 4.7

401- 4.7 a tank leakage

Ensure the tank is not leaking.

401- 4.7 b pressure relief valve/discharge pipe

Ensure the discharge pipe/pressure relief valve is present and working and installed correctly.

401- 4.7 c tank insulation warning

Document a DHW that has a manufacturer's warning against adding insulation to the tank.

401- 4.7 d tank insulation

Ensure the tank is insulated, if required.

401- 4.7 e temperature setting

Ensure the temperature setting on the thermostat(s) has been lowered, if called for, without affecting the life style of the customer.

DHW distribution 401- 4.8

401- 4.8 a water line insulation

Ensure there is insulation present on the first six feet of both the hot and cold water lines.

Fluorescent lighting 401-7-1

Ensure that screw-in compact fluorescent lighting was installed per manufacturer's instructions in the fixtures determined by the initial inspection. Ensure no fluorescent lighting was installed in fixtures with dimmers unless specifically allowed by the bulb manufacturer.

Refrigerator/freezer replacement 401- 7.2

401- 7.2 a refrigerators/freezers

Ensure that refrigerators/freezers were installed per manufacturer's instructions in a location acceptable to the customer.

401- 7.2 b old units

Ensure refrigerators and freezers taken out of service were discarded in an environmentally-sensitive manner. If applicable, ensure that old units were reclaimed only at licensed stations. Ensure that no units taken out of service were returned to service.

Other electric enrgy efficiency measures 401- 7.3

401- 7.2 improvements

Ensure that all materials have been installed PMI and in compliance with local codes. Ensure that the benefit expected in the estimation (repairing water leaks to reduce well water pump operation, etc.) has been achieved.

401- 7.3 waterbeds

Ensure the foam is installed to cover the entire exposed surface of the mattress. Ensure the foam is placed directly on the mattress surface, under any and all covers. Ensure the thermostat temperature for the appliance was lowered at the time of installation of the insulation. Normal operating temperature with the foam in place should be between 70 and 80 degrees F. Ensure that foam waterbed covers were purchased with non-HWAP funds and installed.

Consumer energy education 401- 7.3

401- 7.3 a consumer energy education

Ensure education has been provided concerning such matters as the impact of dirty filters on electric clothes dryers, the impact of dirty coils on refrigerators and freezers, etc.

Procedures for measuring electricity 1506-6

1506- 6.1 meter base load

Use a commercially available kilowatt-hour meter to measure electric usage of refrigerators, well water pumps, etc. Record the date and time for the meter reading period. Be sure to account for the seasonal operating characteristics of the appliance. For instance, many waterbed heaters are not in use in the summer so usage would be underestimated.

Use the following method to calculate savings based on metered energy consumption.

1506- 6.2 a pre-retrofit consumption

i. Determine existing wattage by taking meter reading (Wpre).

ii. Determine the hours of use (Hpre).

iii. Determine the number of days of use per year (Ypre).

iv. Multiply Wpre x Hpre x Ypre and divide by 1000 to calculate pre-retrofit kWh use (kWhpre)

1506- 6.2 b post-retrofit usage

i. Determine the new usage (Wpost).

ii. Determine the new hours of use (Hpost).

iii. Determine the number of hours of use per year (Ypost).

iv. Multiply Wpost x Hpost x Ypost and divide by 1000 to calculate the post-retrofit kWh usage (kWhpost).

Or, use the DOE energy guide usage or manufacturers specifications to determine the consumption for replacement appliances (kWhpost).

1506- 6.2 c annual savings

Determine the annual energy savings from the measures (Sa).

i. Sa = kWhpre - kWhpost.

1506- 6.2 d neat input

Convert to Mbtu for input into neat or other approved audit.

i. Mbtu = (Sa X 3412(Btu/kWh))/1,000,000

ii. Input Mbtu into the neat (or other approved) audit, along with the fuel type saved and the life of the measure. Include the measure in the SIR calculations on the last NEAT input screen.

1506- 6.3 non-metered savings calculation

Use the following method to calculate electricity savings if a kilowatt hour meter is not used.

1506- 6.3 a pre-retrofit consumption

i. Determine existing wattage from data plate or markings (Wpre).

ii. Determine the hours of use (Hpre).

iii. Determine the number of days of use per year (Ypre).

iv. Multiply Wpre x Hpre x Ypre and divide by 1000 to calculate pre-retrofit kWh use (kWhpre)

v. Determine the new usage (Wpost).

vi. Determine the new hours of use (Hpost).

vii. Determine the number of hours of use per year (Ypost).

viii. Multiply Wpost x Hpost x Ypost and divide by 1000 to calculate the post-retrofit kWh usage (kWhpost).

Or, use the DOE energy guide usage or manufacturers specifications to determine the consumption for replacement appliances (kWhpost).

Determine the annual energy savings from the measures (Sa).

i. Sa = kWhpre - kWhpost.

Convert to Mbtu for input into NEAT or other approved audit.
