Ohio Admin. Code 3745-50-270 - Applying for a standardized permit - storage units and treatment units
(A)
Instructions for owners and operators applying for a
standardized permit. Owners and operators applying for a standardized permit
shall follow the procedures in rules 3745-50-250 to 3745-50-320 and 3745-50-700
of the Administrative Code.
(B)
Requirements for
owners and operators submitting support information with a standardized
permitting application. The requirements for a standardized permitting
application can be found in paragraphs (B)(1) to (B)(10) of this rule. Owners
and operators shall submit the standardized permitting application to the
director when the owner or operator submits the "Notice of Intent" under
paragraph (A)(2) of rule 3745-50-702 of the Administrative Code requesting
coverage under a hazardous waste standardized permit:
(1)
The "Part A"
information described in rule
3745-50-43 of the Administrative
Code.
(2)
A meeting summary and other materials required by
paragraph (A) of rule 3745-50-531 of the Administrative Code.
(3)
Documentation of
compliance with the location standards of rule 3745-267-18 and paragraph
(A)(11) of rule
3745-50-44 of the Administrative
Code.
(4)
Information that allows the director to carry out Ohio
EPA's obligations under other federal laws required in
40 CFR
270.3.
(5)
Waste management
unit information required by paragraph (D) of rule
3745-50-44 of the Administrative
Code.
(6)
A certification meeting the requirements of paragraph
(C) of this rule, and an audit of the facility's compliance status with Chapter
3745-267 of the Administrative Code, as required by paragraph (C) of this
rule.
(7)
A closure plan prepared in accordance with rules
3745-267-110 to 3745-267-117 of the Administrative Code.
(8)
The most recent
closure cost estimate for the facility prepared under rule 3745-267-142 of the
Administrative Code and a copy of the documentation required to demonstrate
financial assurance under rule 3745-267-143 of the Administrative Code. For a
new facility, an owner or operator may gather the required documentation sixty
days before the initial receipt of hazardous wastes.
(9)
If the owner or
operator manages wastes generated off-site, the waste analysis
plan.
(10)
If the owner or operator manages waste generated
off-site, documentation showing that the waste generator and the off-site
facility are under the same ownership.
(C)
Certification
requirements. Owners and operators shall submit a signed certification based on
the audit of the owner's or operator's facility compliance with Chapter
3745-267 of the Administrative Code.
(1)
Owner and operator certification shall read as follows:
"I certify under penalty of law that:
(a)
I have personally
examined and am familiar with the report containing the results of an audit
conducted of my facility's compliance status with Chapter 3745-267 of the
Administrative Code, which supports this certification. Based on my inquiry of
those individuals immediately responsible for conducting the audit and
preparing the report, I believe that my [include paragraphs (C)(1)(a)(i) and
(C)(1)(a)(ii) of rule 3745-50-270 of the Administrative Code, whichever
applies]:
(i)
My
existing facility complies with all applicable requirements of Chapter 3745-267
of the Administrative Code and will continue to comply until the expiration of
the permit; or
(ii)
My facility has been designed, and will be constructed
and operated to comply with all applicable requirements of Chapter 3745-267 of
the Administrative Code, and will continue to comply until expiration of the
permit.
(b)
I will make all information that I am required to
maintain at my facility in accordance with rule 3745-50-290 of the
Administrative Code readily available for review by Ohio EPA and the public;
and
(c)
I will continue to make all available information
required by rule 3745-50-290 of the Administrative Code available until the
permit expires. I am aware that there are significant penalities for submitting
false information, including the possibility of fine and imprisonment for
knowing violation."
(2)
Owners and
operators shall sign this certification following the requirements of rule
3745-50-42 and paragraphs (A)
and (B) of rule
3745-50-44 of the Administrative
Code.
(3)
This certification shall be based upon an audit that an
owner or operator conducts of the facility's compliance status with Chapter
3745-267 of the Administrative Code. A written audit report, signed and
certified as accurate by the auditor, shall be submitted to the director with
the "Notice of Intent" in paragraph (A)(2) of rule 3745-50-702 of the
Administrative Code.
