Ohio Admin. Code 3745-50-700 - General information about standardized permits - standardized permit procedures
(A)
The standardized permit is a special form of hazardous
waste management permit, that may consist of a uniform portion that the
director issues in all cases, and a supplemental portion that the director
issues at the director's discretion. A "standardized permit" is defined in rule
3745-50-502 of the Administrative Code.
(1)
Components of the
uniform portion. The uniform portion of a standardized permit consists of terms
and conditions, relevant to the units owners or operators are operating at the
facility, in Chapter 3745-267 of the Administrative Code. If an owner or
operator plans to operate under the standardized permit, the owner or operator
shall comply with the applicable terms and conditions.
(2)
Components of the
supplemental portion. The supplemental portion of a standardized permit
consists of site-specific terms and conditions, beyond those of the uniform
portion, that the director may impose on the owner or operator's facility, as
necessary to protect human health and the environment. If the director issues
an owner or operator a supplemental portion, the owner or operator shall comply
with the site-specific terms and conditions the supplemental portion
imposes.
(a)
When required under rule 3745-267-101 of the Administrative
Code, provisions to implement corrective action should be included in the
supplemental portion.
(b)
Unless otherwise specified, the supplemental permit
terms and conditions apply to an owner's or operator's facility in addition to
the terms and conditions of the uniform portion of the standardized permit and
not in place of any of those terms and conditions.
(B)
Eligibility for a standardized permit.
(1)
Owners or
operators may be eligible for a standardized permit if the owners or
operators:
(a)
Generate hazardous waste and then store or non-thermally
treat the hazardous waste on-site in containers, tanks, or containment
buildings; or
(b)
Receive hazardous waste generated off-site by a
generator under the same ownership as the receiving facility, and then store or
non-thermally treat the hazardous waste in containers, tanks, or containment
buildings.
(c)
In either case, the director will inform the owner or
operator of the owner's or operator's eligibility when a decision is made on
the owner or operator's permit.
