Okla. Admin. Code § 340:75-19-19 - Termination of parental rights to the Indian child
Proceedings to terminate parental rights to the
(1) evidence beyond a reasonable doubt,
supported by testimony of a qualified expert witness that continued custody by
the parent or Indian custodian is likely to result in serious emotional or
physical harm or damage to the child; and
(2) a showing that active efforts were made
to provide remedial and rehabilitative services designed to prevent the breakup
of the Indian family and that these efforts proved unsuccessful.
