(1) If any
party, in the regular course of the party's business or activity, has kept or
recorded any memorandum, writing, entry, print, reproduction or a combination
thereof, of any act, transaction, occurrence or event, and in the regular
course of the party's business or activity has caused any or all of the same to
be recorded, copied or reproduced by any photographic, photostatic, microfilm,
micro-card, miniature photographic, optical imaging or other process that
accurately reproduces or forms a durable medium for so reproducing the
original, the original may be destroyed in the regular course of business. Such
reproduction, when satisfactorily identified, is as admissible in evidence as
the original itself whether the original is in existence or not at the time a
party introduces into evidence such reproduction. The introduction of a
reproduced record, enlargement or facsimile does not preclude admission of the
original.
(2) If a party introduces
into evidence a reproduction described in subsection (1), the exhibit index
described in OAR 438-007-0018 will include the following certification: "The
attached exhibits contain reproductions as described in 438-007-0040. I hereby
certify that the reproductions were created in the regular course of a party's
business or activity."
