Or. Admin. R. 581-015-2495 - Funds and Property Not to Benefit Private Schools
(1) A public agency may not use IDEA funds to
finance the existing level of instruction in a private school or to otherwise
benefit the private school.
(2) The
public agency must use IDEA funds to meet the special education needs of
students enrolled in private schools, but not for:
(a) The needs of a private school;
or
(b) The general needs of the
students enrolled in the private school.
