Or. Admin. R. 808-002-0320 - Defective Work

"Defective Work"as used in ORS 671.610 means work which is found to be negligent or improper:

(1) In final administrative orders, arbitration awards, court orders, or any combination of thereof;

(2) Based on claims made under ORS 671.695 to 671.703 against a landscape contracting business by a property owner, the agent of a property owner, a licensed landscape contracting business or a construction contractor licensed under ORS chapter 701 against a licensed landscape contracting business subcontractor, or any combination thereof

(3) If there have been at least 3 such final administrative orders, arbitration awards, or court orders issued against a landscape contracting business; and,

(4) No more than 5 years elapsed between the date the oldest final administrative order, arbitration award, or court order being considered was issued, and the date the most recent final administrative order, arbitration award, or court order being considered was issued.
