Or. Admin. R. 839-001-0440 - Special Provisions for Payment of Wages at Termination for Seasonal Farmworkers and Seasonal Reforestation Workers
(1) Unless the conditions described in ORS
652.145(1)(a)
apply, when a seasonal farmworker or seasonal reforestation worker terminates
employment because of discharge or mutual consent, all wages earned and unpaid
become due and payable on the last day the employee works.
(2) When a seasonal farmworker or seasonal
reforestation worker quits employment and gives the employer at least 48 hours
notice of intent to quit, all wages earned and unpaid become due and payable on
the last day the employee works.
(3) When a seasonal farmworker or seasonal
reforestation worker quits employment and fails to give the employer at least
48 hours notice, all wages earned and unpaid become due and payable within 48
hours after the employee quits or on the next regularly scheduled payday,
whichever comes first.
