Notwithstanding OAR 603-048-0630(3)(c), a grower seeking resampling and retesting of a production area as described in OAR 603-048-0630(3) on or after September 1, 2023 is not required to subdivide the production area if the initial preharvest test result does not exceed 1.0 percent THC on a dry weight basis. In addition, notwithstanding OAR 603-048-0630(3)(d), a grower that does not subdivide in accordance with this rule is not required to identify subdivided harvest lots.
