Or. Admin. Code § 632-037-0125 - Fish and Wildlife Standards
The Department shall require a mining operation to comply with protection standards for fish and wildlife consistent with policies of the Department of Fish and Wildlife, including:
(1) Protective measures to maintain an
objective of zero wildlife mortality.
(2) All chemical processing solutions and
associated wastewater must be covered or contained to preclude access by
wildlife, or maintained in a condition that is not harmful to wildlife.
(3) Onsite and offsite mitigation
ensuring there is no overall net loss of habitat value.
(4) No loss of existing critical habitat of
any state or federally listed threatened or endangered fish or wildlife
species.
(5) Any other standard
adopted by rule by the Department of Fish and Wildlife applicable to a mining
operation.
