34 Pa. Code § 49.17 - Cases involving danger of imminent harm
(a) In cases involving danger of imminent
harm, at the expiration of the period provided in the order to correct under
§
49.12 (relating to notice of
violation and order to correct), the Department will reinspect the building to
determine whether compliance has occurred. Following this reinspection, the
Department will issue a determination as soon as practicable thereafter as to
the status of the original order to correct.
(b) If the Department determines that the
building no longer involves danger of imminent harm, the Department will
proceed under §
49.13 (relating to determination
of compliance or noncompliance).
(c) If the Department determines that the
building continues to involve danger of imminent harm, the Department will so
indicate in its determination and may proceed to initiate an action in law or
in equity in a court of competent jurisdiction.
