37 Pa. Code § 171.77 - Transfer to a Court of Common Pleas
(a) If an arbitration panel is not selected
as defined in subsection (b) by the Administrator within 90 days after the
filing of a certificate of readiness as defined in §
171.71 (relating to certificate of
readiness), the Administrator upon petition of any party will forthwith
transfer the claim to the Court of Common Pleas having venue over the claim as
defined in Pa.C.R.P. No. 1807.
(b)
For purposes of this section, an arbitration panel shall be considered selected
when the Administrator has chosen a health care provider, attorney, and
layperson to sit on that arbitration panel. After the selection is made, the
Administrator will send the list of panel members to the parties under §
171.73 (relating to panel
selection procedure).
