37 Pa. Code § 197.47 - Scheduling and announcement of hearings
(a) Wherever possible, the Hearing Board will
schedule a hearing to be held within 30 days of the last date for filing reply
briefs or, when a prehearing conference is held, within 30 days of the
conference unless this time is extended by mutual agreement of the parties and
the Hearing Board.
(b) The Hearing
Board will determine the location of the hearing. The hearing will be in the
county where the health care facility in question is situated, if possible;
otherwise, the hearing will be held in the health service area in which the
certificate of need application arises.
(c) The time, date and place of the hearing
will be announced by the Hearing Board in the following manner:
(1) By written notice to parties of record no
later than 21 days before the hearing date.
(2) By publication in a newspaper of general
circulation in the area where the certificate of need application arises. The
publication will occur at least 14 days before the date of the
hearing.
(3) By publication in the
Pennsylvania Bulletin at least 14 days before the date of the
hearing.
(d) The notices
required by subsections (c)(2) and (3) shall include the time within which
petitions to intervene shall be filed with the Hearing Board.
