37 Pa. Code § 79.87 - Hearing examiner recommendation
(a)
Within 30 days of conclusion of the hearings, the hearing examiner will propose
findings of fact and conclusions of law to the Commission.
(b) Upon receipt and after review of the
hearing examiner's proposed findings of fact and conclusions of law and any
exceptions and briefs, which may be submitted by either party, the Commission,
or its designees, shall issue a final adjudication.
(c) The Executive Director shall forward the
final adjudication to the officer, CFI, MI or school, or their legal counsel,
if the officer, CFI, MI or school has made the Executive Director aware of the
representation, and the appropriate chief probation officer and president
judge.
(d) The officer, CFI, MI,
school or Commission shall have the right to appeal the final adjudication in
accordance with Pa.R.A.P. and
2 Pa.C.S. §§
501-508 and
701-704 (relating to
Administrative Agency Law).
