55 Pa. Code § 6000.303 - No license factors
If there is noncompliance with either of the following two sections at the time the license is to be issued, no license will be issued:
(1) Section
6400.13 (relating to maximum
capacity)-first sentence. This is a no license regulation for new facilities
and for facilities with no occupancy permit.
(2) Section
6400.18 (relating to reporting of
unusual incidents). Each incidence of abuse will be investigated and evaluated
individually by the Office of Mental Retardation before any negative licensing
action is taken.
