A. Preliminary
Decision and Advisory Opinions - The preliminary decision of the Board and
advisory opinions of designated agencies are interlocutory decisions for which
judicial review is not available until the Board issues its Final
Decision.
B. Final Decision,
Judicial Review - Judicial review of a Board decision is governed by R.I. Gen.
Laws §
42-98-12.
C. Judicial Review of Rules - The validity or
applicability of any rule of the Board may be determined in an action for
declaratory judgment in the Superior Court of Providence County, when it is
alleged that the rule, or is threatened application, interferes with or
impairs, or threatens to interfere with or impair, the legal rights and
privileges of the plaintiff. The Board shall be made a party to the
action.
