S.C. Code Regs. § 19-470.10 - Energy Standards Appeal Procedure
(a) The Council shall review and decide
appeals to the requirements of the energy standards when certain occupancy or
construction conditions are proven to exist.
(b) Appeals may be brought before Council by
any person, persons or parties who may be affected by any provision of or
decision made pursuant to the administration or enforcement of the Energy
Standards.
(c) All appeals shall be
submitted on a form approved by Council and must fully explain and justify the
issues to be considered. The submittal should include a list of the persons
wishing to testify. Each appeal shall be submitted on a separate form.
Information submitted shall be legible and each form must contain the
following:
(1) Name, address and phone number
of the person making the request;
(2) Name of jurisdiction in which the
structure involved is located;
(3)
The nature of the appeal;
(4) The
basis or reason for the appeal.
(d) Any decision of Council may be appealed
to a court of competent jurisdiction.
