S.C. Code Regs. 28-27 - Petition for Adoption of Rules
A. Any
interested person may petition the Administrator requesting the promulgation,
amendment or repeal of a rule. The petition shall be in writing, be addressed
to the Administrator and include a clear statement of the petitioner's proposal
and may include any supporting data that may assist the Administrator in
reaching a determination. The petition need not be of any particular form, but
must contain the information required by this section.
B. If the Administrator deems the matter to
be of sufficient public importance, in the exercise of his absolute discretion
he may schedule the matter for a public hearing, pursuant to the procedures
provided in the Administrative Procedures Act, (as amended).
C. Within thirty (30) days after submission
of a petition, the Administrator either shall deny the petition in writing to
the petitioner, stating his reasons for the denial, or shall initiate
rule-making procedures in accordance with the provisions on procedures for
adoption of rules in the Administrative Procedures Act, (as amended).
