S.D. Admin. R. 20:08:07:20 - Unsolicited orders

Any purchaser acquiring a security pursuant to the exemption specified in section SDCL 47-31B-202(6) shall acknowledge in writing that his/her order to buy was unsolicited. However, no such acknowledgement is required if the confirmation furnished the purchaser is clearly marked "Unsolicited Order" or the broker-dealer furnishes the purchaser before or concurrently with the delivery of the confirmation a memorandum stating that the transaction is based upon an unsolicited order to buy.
