Tenn. Comp. R. & Regs. 0250-07-12-.01 - PURPOSE AND SCOPE OF CHAPTER
(1) The purpose of
this chapter is to provide, in compliance with T.C.A. §§
36-1-127 - 36-1-132, and
§§
36-1-136 and
36-1-137, procedures for
registering with the Contact Veto Registry, and access to records by eligible
persons and other papers relating to adoptions or attempted adoptions of
certain persons as defined herein, whose records, whether sealed, whether in
any court record, or whether in any post adoption record, if the adoption was
finalized by the entry of an order of adoption or an order of dismissal, or if
the adoption petition was filed, on or after March 16, 1951, or which adoption
was otherwise never completed due to the abandonment as determined by the
Department, on or after March 16, 1951, of any further necessary activity
related to the completion of the adoption.
(2) This Chapter does not govern access to
record for persons whose adoptions were finalized by orders of adoption entered
prior to March 16, 1951, or for whom surrenders for adoption were executed
prior to March 16, 1951, or for persons who were subject to placement through
the Tennessee Children's Home Society, its branches and divisions. Persons in
this class are given access to records pursuant to Chapter 0250-7-7 or as such
Chapter may be redesignated.
