Tenn. Comp. R. & Regs. 0780-01-55-.09 - OTHER LAWS; SEVERABILITY
(1) The requirements
of Title 56, Chapter 8, Part 1, and any related rules , shall apply to
individuals and entities registered under this chapter. The activities and
duties of navigators and certified application counselors shall be deemed to
constitute transacting the business of insurance.
(2) The requirements of this chapter shall
not apply to any individual or entity licensed as an insurance producer in this
state or any entity or individual exempted from having to have an insurance
producer license under T.C.A. §
56-6-104(b)(1).
(3) The requirements of this chapter shall
not apply to hospitals licensed in this state under Title 68 or Title 33 of the
Tennessee Code Annotated.
(4) The
requirements of this chapter shall not apply to state and local government
agencies, employees acting in their official capacities as employees of state
and local government agencies, or any contractors to the extent of their
official duties for state and local government agencies.
(5) If any provision of this chapter or its
application to any person or circumstance is held invalid by a court, the
invalidity does not affect other provisions or applications of this chapter
that can be given effect without the invalid provision or application, and to
this end the provisions of the chapter are severable and the valid provisions
or applications shall remain in full force and effect.
