Tenn. Comp. R. & Regs. 0800-02-13-.05 - SETTLEMENT
(1) In accordance with applicable statutes
and as warranted by the facts and circumstances found during the investigation
or inspection or the response to the notice, the Administrator or
Administrator's Designee may dismiss the matter and/or enter into a settlement
agreement resolving potential penalties with the Employer, Employee, or other
person or entity subject to penalties under the Workers' Compensation Law or
Bureau Rules. In deciding whether to dismiss the matter and/or to enter into a
settlement agreement, the Administrator or Administrator's Designee may take
into consideration actions taken by the Employer, Employee, or other person
subject to penalties under the Workers' Compensation Law or Bureau Rules to
mitigate or correct the circumstances relevant to the potential penalty,
non-compliance, or violation.
(2)
All settlement agreements resolving instances of potential violations or
potential non-compliance with the Workers' Compensation Law or Bureau Rules
shall be set forth in writing and shall be signed by the Employer, Employee, or
other person or entity subject to penalties as well as by the Administrator or
Administrator's Designee.
