Tenn. Comp. R. & Regs. 1200-23-02-.04 - GENERAL PROVISIONS
(1) Severability
If any provision of this section, or the application thereof to any person or circumstance, is held invalid, the remainder of these rules, or the application of such provision to other persons or circumstances, shall not be affected thereby.
(2) Review of Plans
(a) Submission of Plans. Whenever a Bed and
Breakfast establishment is constructed or extensively remodeled and whenever an
existing structure is converted to use as a Bed and Breakfast Establishment, at
least one (1) set of properly prepared plans and specifications for such
construction, remodeling, or conversion shall be submitted to the Commissioner
for review and approval before construction, remodeling or conversion is begun.
The plans and specifications shall indicate the proposed layout, arrangement,
mechanical plans, and construction materials of work areas, sleeping areas
and/or rooms and the type and model of proposed fixed equipment and facilities.
The Commissioner shall approve the plans and specifications if they meet the
requirements of these rules. No Bed and Breakfast establishment shall be
constructed, extensively remodeled, or converted except in accordance with
plans and specifications approved by the Commissioner.
(b) Pre-Operational Inspection. After plans
and specifications have been approved by the Commissioner, the Bed and
Breakfast establishment shall not start operations until the Commissioner has
made a pre-operational inspection and has determined compliance with the
approved plans and specifications and with the requirements of these
rules.
